Customer Terms of Service

1. Acceptance of Terms

By accessing or using PipelineRetriever's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.

2. Service Description

PipelineRetriever provides a cloud-based revenue operations platform that combines CRM, sales automation, marketing, customer success, and analytics tools ("Services"). We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

3. Account Registration

To use our Services, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorized access or security breach
  • Be at least 18 years old or the age of majority in your jurisdiction

You are responsible for all activities that occur under your account.

4. Subscription and Billing

4.1 Subscription Plans: PipelineRetriever offers various subscription tiers with different features and usage limits. Pricing is available on our website and may be updated with reasonable notice.

4.2 Billing: Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Payment Methods: You authorize us to charge your chosen payment method for all fees due. You must provide current, complete, and accurate payment information.

5. Data and Privacy

5.1 Your Data: You retain all rights to the data you submit to our Services ("Customer Data"). You grant us a limited license to process Customer Data solely to provide the Services.

5.2 Data Location: Customer Data is hosted in the United States. By using our Services, you consent to the storage and processing of your data in the United States.

7. Intellectual Property

7.1 Our IP: The Services, including all software, designs, trademarks, and content (excluding Customer Data), are owned by PipelineRetriever and protected by intellectual property laws.

7.2 License: We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes during your subscription term.

8. Termination

8.1 By You: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

8.2 By Us: We may suspend or terminate your account if you breach these Terms, fail to pay fees, or engage in prohibited activities. We will provide reasonable notice except in cases of serious violations.

8.3 Effect of Termination: Upon termination, your access to the Services will cease, and we may delete your Customer Data after a reasonable period. You should export your data before termination.

9. Warranties and Disclaimers

9.1 Service Availability: We strive to provide 99.9% uptime but cannot guarantee uninterrupted access. Scheduled maintenance will be performed with reasonable notice.

9.2 Disclaimer: THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR MEET YOUR REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIPELINERETRIEVER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold PipelineRetriever harmless from any claims, damages, losses, and expenses (including legal fees) arising from: (a) your use of the Services, (b) your Customer Data, (c) your violation of these Terms, or (d) your violation of any third-party rights.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Services at least 30 days before the changes take effect. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.

14. General Provisions

14.1 Entire Agreement: These Terms constitute the entire agreement between you and PipelineRetriever regarding the Services.

14.2 Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.

14.3 Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.

14.4 Assignment: You may not assign these Terms without our written consent. We may assign these Terms without restriction.
